1. Acceptance of Terms

By accessing or using Entrolytics services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you're using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Entrolytics provides web analytics services including visitor tracking, event analytics, conversion funnels, performance monitoring, and reporting tools. We offer both cloud-hosted and self-hosted deployment options depending on your subscription plan.

3. Account Registration

To use our Services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 16 years old or have parental consent

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use our Services to:

• Violate any applicable laws or regulations
• Track users without appropriate legal basis
• Collect personal data in violation of privacy laws
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Use automated systems to access our Services excessively
• Resell or redistribute our Services without authorization
• Track illegal content or activities

5. Subscription and Payment

5.1 Billing

Paid plans are billed in advance on a monthly or annual basis. Payments are processed through Stripe. You authorize us to charge your payment method for all applicable fees.

5.2 Free Plan

The free plan includes 25,000 pageviews per month, 2 websites, and 30-day data retention. We reserve the right to modify free plan limits with 30 days notice.

5.3 Upgrades and Downgrades

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of the next billing cycle.

5.4 Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. After 14 days, fees are non-refundable except as required by law.

6. Data Ownership

You retain all rights to the analytics data collected through our Services. We process your data solely to provide the Services. You can export your data at any time in standard formats. Upon account termination, your data will be deleted within 30 days unless you request earlier deletion or data export.

7. Intellectual Property

Entrolytics and its licensors retain all rights to the Services, including software, designs, trademarks, and documentation. You receive a limited, non-exclusive license to use the Services according to these Terms. Our tracking scripts and SDKs are provided under open-source licenses as specified in their repositories.

8. Service Level Agreement

For paid plans, we commit to 99.9% uptime measured monthly. Downtime for scheduled maintenance (with 24 hours notice) is excluded. Enterprise customers receive custom SLA terms. Service credits for SLA breaches are available upon request.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTROLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Entrolytics from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

Either party may terminate this agreement at any time. You can cancel your account through the dashboard settings. We may suspend or terminate accounts that violate these Terms or for non-payment. Upon termination, your right to access the Services ends immediately.

12. Modifications

We may modify these Terms at any time. We'll notify you of material changes via email or dashboard notification at least 30 days before they take effect. Continued use after changes constitutes acceptance. If you disagree with changes, you may terminate your account.

13. Governing Law

These Terms are governed by the laws of the European Union. Any disputes shall be resolved in the courts of [Jurisdiction]. You waive any objection to venue in these courts.
